Cookies and Similar Technologies

We use cookies and similar tracking technologies to operate the Services, remember your preferences, analyse site performance, and deliver relevant advertising.

  • Performance and analytics cookies that help us understand how visitors use our site (e.g. Google Analytics).
  • Advertising and targeting cookies that allow us and our partners to show you relevant ads on other websites and platforms (e.g. Meta Pixel, Google Ads).

You can manage your cookie preferences through your browser settings or through the privacy controls available on our site. Disabling certain cookies may affect how the Services function.

Advertising and Analytics Partners

To help us understand how our website is used and to show you relevant ads, we work with the following partners:

  • Meta Platforms, Inc. (Facebook and Instagram). We use the Meta Pixel and Conversions API to measure the effectiveness of our advertising and to show you relevant ads on Facebook and Instagram. Meta may process data about your visit to our site in accordance with its own privacy policy, available at https://www.facebook.com/privacy/policy/.
  • Google LLC. We use Google Analytics to understand how visitors interact with our site, and Google Ads (including remarketing) to show you relevant ads across Google's network. Google processes data in accordance with its privacy policy, available at https://policies.google.com/privacy.
  • Shopify Inc. Shopify hosts our store and provides analytics and advertising tools that help us improve the Services. Shopify's privacy policy is available at https://www.shopify.com/legal/privacy.

You can opt out of interest-based advertising at any time using the tools provided by our partners or by visiting https://optout.aboutads.info/ (Digital Advertising Alliance) or https://optout.networkadvertising.org/ (Network Advertising Initiative).

We Do Not Sell Your Personal Information

We do not sell your personal information in exchange for money. However, some sharing of information with advertising partners (for example, through cookies used for personalised advertising) may be considered a "sale" or "share" under the California Consumer Privacy Act (CCPA/CPRA) and similar US state privacy laws. You have the right to opt out of this at any time — see the "Your Rights and Choices" section below, or click the "Do Not Sell or Share My Personal Information" link in our website footer.

How We Disclose Personal Information

In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:

  • With Shopify, vendors and other third parties who perform services on our behalf (e.g. IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping).

  • When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.
  • With our affiliates or otherwise within our corporate group.
  • In connection with a business transaction such as a merger or acquisition, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. To learn more about how Shopify uses your personal information and any rights you may have, you can visit the Shopify Consumer Privacy Policy at https://www.shopify.com/legal/privacy.

Third Party Websites and Links

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

Children's Data

The Services are not intended for children under the age of 13. In accordance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13. If you are the parent or guardian of a child under 13 who has provided us with personal information, please contact us at support@healingcircleskin.com and we will delete that information promptly.

As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable US state privacy laws) personal information of individuals under 16 years of age.

Security and Retention of Your Information

We take the security of your personal information seriously and implement appropriate technical and organisational measures to protect it against unauthorised access, alteration, disclosure, or destruction. However, no method of transmission over the internet or electronic storage is completely secure, so we cannot guarantee absolute security. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

We retain your personal information only for as long as is necessary to fulfil the purposes for which it was collected, including:

  • Order and transaction records: retained for up to 7 years to comply with US tax, accounting, and consumer protection laws.
  • Account information: retained while your account is active and for a reasonable period afterwards, unless you request deletion.
  • Marketing preferences: retained until you unsubscribe or request deletion.
  • Customer support communications: typically retained for up to 3 years.

When we no longer need your personal information, we will securely delete or anonymise it.

  • Right to Limit Use of Sensitive Personal Information. Where applicable, you have the right to request that we limit the use or disclosure of sensitive personal information to what is necessary to provide the Services.
  • Right to Non-Discrimination. We will not discriminate against you for exercising any of your privacy rights. We will not deny you goods or services, charge different prices, or provide a different level of quality because you exercised your rights.

  • Managing Communication Preferences. We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made.

To exercise any of these rights, email us at support@healingcircleskin.com. We will respond to your request within 45 days as required by the CCPA and similar US state privacy laws (with the possibility of an additional 45-day extension when reasonably necessary, in which case we will notify you).

We may need to verify your identity before we can process your requests, as permitted or required under applicable law. You may also designate an authorised agent to make requests on your behalf. Before accepting a request from an agent, we will require proof that you have authorised them to act on your behalf, and we may need you to verify your identity directly with us.
